Cynthia Grant Bowman

Pen Name: None Connection to Illinois: The author was a National Endowment for The Humanities Post Doctoral Fellow at the University of Chicago. She received Juris Doctorate from Northwestern University in 1982 and taught law and gender studies there before teaching at Cornell. Biography: Bowman received a B.A. with honors from Swarthmore College and Ph.D. in Political Science from Columbia University. Before entering law school, she taught political science and spent a year at the University of Chicago as a National Endowment for the Humanities postdoctoral fellow in the history and philosophy of the social sciences. She received a J.D. with honors from Northwestern University School of Law in 1982, after which she clerked for Judge Richard D. Cudahy on the U.S. Court of Appeals for the Seventh Circuit and was an associate at Jenner & Block in Chicago for five years. She was a Professor of Law and of Gender Studies at Northwestern University. She oversaw an exchange relationship between Northwestern Law School and the University of Ghana for five years. Currently, she is the Dorothea S. Clarke Professor of Feminist Jurisprudence, at Cornell Law School.Bowman has published widely in diverse areas having to do with law and women, such as women in the legal profession, sexual harassment, and legal remedies for adult survivors of childhood sex abuse and is co-author of ''Feminist Jurisprudence: Taking Women Seriously''. Professor Bowman has extensive experience teaching, consulting, and doing research about women and law in Africa and is the co-author, with Akua Kuenyehia, of ''Women and Law in Sub-Saharan Africa''. She has also published and spoken widely about domestic and sexual violence in the African context.

In Unmarried Couples, Law, and Public Policy, Cynthia Grant Bowman explores the legal recognition of heterosexual cohabiting couples in the United States. Unmarried cohabitation has increased at a phenomenal rate in the U.S., over the last few decades, but the law has not responded to the legal issues raised by this new family form. Although a majority of cohabiting unions dissolve within the first two years, many last longer and function like other families, and a large number of children also reside in these households. If one partner dies, is injured, or leaves the family, the remaining family members are left in vulnerable positions in almost every state without survivors' benefits, compensation for loss of a wage-earning partner, or remedies similar to those available upon dissolution of a marriage. The author argues that the benefits given to formal marriage should be extended to cohabitants who have lived together for more than two years or give birth to a child. In order to avoid these consequences, a couple would need to opt out of them by contract. Professor Bowman reaches this conclusion after a thorough review of the history of the legal treatment of cohabitation in the United States, the inadequacy of the legal remedies available to cohabitants in most states, the now-voluminous social science literature about cohabitation, and the experience of six other countries (England, Canada, Australia, France, The Netherlands, and Sweden) that have attempted a variety of legal reforms to address the problems of cohabitants.--Jacket. |
